RESOLUTION NO. 05-72 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF PEORIA, MARICOPA COUNTY, ARIZONA, DECLARING AND ADOPTING THE RESULTS OF THE SPECIAL ELECTION HELD ON MAY 17, 2005; AND ORDERING THE RECORDING OF SUCH RESOLUTION AND CERTIFICATE AND DECLARING AN EMERGENCY. . WHEREAS, the City of Peoria, Maricopa County, Arizona, by its duly appointed City Clerk on the 27th day of January 2005 and the 3rd day of February, 2005 did issue a call and notice for a special election; and did cause to be submitted to the qualified electors of the City at a Special Election held in and for the City of Peoria on the 17th day of May, 2005 six propositions and four General Obligation Bond questions; and WHEREAS, the City Council did cause notice of the Special Election to be given by the City Clerk publishing notice thereof in the Arizona Business Gazette newspaper as provided by law, such newspaper published in and having general circulation within said City, that said notice as so published did specify the place where at such election was to be held, and the issues to be voted upon, copy of said notice with the affidavit of publication attached thereto, being now on file and a part of the official records of the City Council of the City of Peoria; and WHEREAS, the election returns have been presented to and been canvassed by the City Council. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Peoria, Maricopa County, Arizona, as follows: SECTION 1: That pursuant to A.R.S. Sec. 35-454(D), a certificate disclosing the purpose of election, the total numbers of votes cast, the total numbers of votes for and against, creating the indebtedness and whether the indebtedness is ordered, is attached as Exhibit "A". SECTION 2: That the total number of ballots cast at said special election, as shown by the poll lists, is set forth on Exhibit "A", Certificate of Bond Election, attached and incorporated to this resolution. SECTION 3: That the number of provisional ballots is set forth on Exhibit "B", and that total number of voters found to be ineligible is set forth on Exhibit “B". SECTION 4: That it is hereby found, determined and declared of record that the following questions did receive the approval of a majority of the electors of the City voting on the questions at the special bond election and that the questions have been legally approved and carried: QUESTION 1: WATER TREATMENT, WATER SYSTEM, WASTEWATER AND DRAINAGE BONDS QUESTION 2: PUBLIC SAFETY AND MUNICIPAL OPERATIONS BONDS QUESTION 3: PARKS, RECREATION AND LIBRARY BONDS QUESTION 4: STREETS, BRIDGES, TRAFFIC CONTROL AND TRANSPORTATION BONDS SECTION 5: That it is hereby found, determined and declared of record that the following propositions did receive the approval of a majority of the electors of the City voting on the propositions at the special election and that the propositions have been duly approved and carried: Proposition 100 – Pertaining to ayes and nays to be recorded and pertaining to emergency measures and pertaining to publication of ordinances and pertaining to filing, recording and certifying of ordinances and resolutions and using ordinances and resolutions as evidence. (Resolution No. 05-03) Votes Yes: 6,914 Votes No: 2,329 Proposition 101 – Pertaining to salaries, generally, Citizens Commission on Salaries for Elected City Officials. (Resolution No. 05-04) Votes Yes: 5,222 Votes No: 4,070 Proposition 102 – Pertaining to City Manager, appointment of and evaluation and pertaining to City Attorney, appointment of and evaluation. (Resolution No. 05-12) Votes Yes: 7,118 Votes No: 2,129 Proposition 300 – Rezoning land in the city located near Lake Pleasant Parkway and Happy Valley Road (Interim State Route 303) from Travel Trailer Park (RMH-3) District to Planned Area Development (P.A.D.) District including the report dated May 20, 2004 on file. (Ordinance No. 04-180) Votes Yes: 7,006 Votes No: 2,638 Proposition 301 – Rezoning land in the city near Lake Pleasant Parkway and Happy Valley Road (Interim State Route 303) from Suburban Ranch (SR-43) District to Planned Area Development (P.A.D.) District, including the report dated April 14, 2004 on file. (Ordinance No. 04-181) Votes Yes: 6,748 Votes No: 2,881 Proposition 302 – Authorize a building at the Municipal Complex Southwest corner providing central locations of administrative departments as outlined in the FY 2005 -2014 Capital Improvements Plan. Votes Yes: 5,403 Votes No: 3,781 SECTION 6: That the total number of ballots cast at said Special Election, as shown by the final results as issued by the Maricopa County Recorder’s Office, is set forth on Exhibit “B” attached to and incorporated to this resolution. SECTION 7: That it is set forth on Exhibit “C” attached to and incorporated to this resolution, the official title of each proposition and the specific bond question along with the vote count thereof for each question; SECTION 8: That all orders or resolutions in conflict be and the same are, to the extent of such conflict, hereby repealed, and that this resolution be in full force and effect immediately upon its adoption. That a special bond election was duly called and held in and for the City of Peoria, Arizona (hereinafter referred to as the "City"), on May 17, 2005, under the provisions of Title 35, Chapter 3, Article 3, Arizona Revised Statutes, as amended, when there was submitted to the qualified electors of the City the questions as shown on the attached form of ballots; 2. That the poll and tally lists and the official returns of the election boards that conducted the special bond election were filed with the Maricopa County Elections Department pursuant to an Intergovernmental Agreement with the City of Peoria, authorized by the duly appointed and acting officials of the City and County and on May 24, 2005 that this Mayor and Council met and canvassed the returns of the special bond election as prescribed by law; 3.
