CITY OF PEORIA, ARIZONA COUNCIL CHAMBER April 4, 2006 A Regular Meeting of the City Council of the City of Peoria, Arizona was convened at 8401 W. Monroe Street in open and public session at 7:01 p.m. Following a moment of silence, Councilmember Evans led the Pledge of Allegiance. PRESENTATION Grady Miller, Director of Communications and Public Affairs, gave an introduction prior to the viewing of an excerpt of the Hurricane Katrina Relief Video. Mayor Keegan had formally conveyed the equipment and supplies donated by the City of Peoria to the City of Long Beach, Mississippi following Hurricane Katrina. The video documented the damage to Long Beach, Mississippi and Mayor Keegan’s trip. Mr. Miller announced that the video in its entirety would be highlighted at an event on April 17, 2006, at 10 a.m. in Council Chambers. Terry Ellis, City Manager, noted that the Mayor of Long Beach expressed his city’s gratitude for the assistance. Mr. Ellis also shared that the Police Chief of Long Beach had stated that their city could not have begun recovery without outside help. Mayor Keegan reported that the City of Long Beach still continues to have pressing needs for assistance, and he encouraged individuals and organizations to continue to find ways to provide relief. Councilmember Dennis noted that the Deer Valley School District and the Peoria School Districts are interested in helping. CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and was enacted by one motion. CONSENT – New Business: Mayor Keegan asked if any Councilmember wished to have an item removed from the Consent Agenda. No comments were received. Motion was made by Councilmember Leone, seconded by Councilmember Evans, to approve the consent agenda as submitted. Upon vote, the motion carried unanimously. 1C Authorize Expenditure, Peoria Sports Complex, Wireless Internet Access Authorized an expenditure in the amount of $10,000 for the installation of a Wi-Fi connection to provide wireless Internet access into the stadium press box at the Peoria Sports Complex; Authorized an expenditure in the amount of $1,500 for ongoing costs of the wireless internet service; and Approved a budget transfer in the amount of $10,000 from General Fund Reserves to the Sports Complex Improvements Reserve Fund and $1,500 from General Fund Reserves to the Sports Complex Internet and Cable Charges Account. 2C Authorize Expenditure, Peoria Sports Complex, Scoreboard Video Addition Authorized an expenditure in the amount of $10,000 for the installation of a fence around the base of the video scoreboard and a protective enclosure of the power and air conditioning units at the Peoria Sports Complex; and Approved a budget transfer in the amount of $10,000 from General Fund Reserves to the Sports Complex Ticket Surcharge Grounds/Detention R&M Account. 3C Contract, Principal Decision Systems International, Police Department, Software Purchase Awarded a contract in the amount of $71,500 to Principal Decision Systems International for the purchase of automated staffing system software. (Project R050067) REGULAR AGENDA NEW BUSINESS 15R Grant, Governor’s Office of Highway Safety, Selective Traffic Enforcement Program RESOLUTION NO. 06-67 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF PEORIA, MARICOPA COUNTY, ARIZONA, ACCEPT AN AWARD OF A SUPPLEMENTAL GRANT IN THE AMOUNT OF $50,297.04 FROM THE GOVERNER’S OFFICE OF HIGHWAY SAFETY TO ASSIST IN FUNDING SUPPLEMENTAL LAW ENFORCEMENT OPERATIONS. Police Chief Leonardo explained that the Police Department requests approval to accept a Selective Traffic Enforcement Program (STEP) grant from the Governor’s Office of Highway Safety in the amount of $50,297.04 to fund eight moving radar units ($30,251.04) and fund overtime ($20,046) to focus on aggressive driving, speed, DUI, seatbelt, and child restraint violations. Motion was made by Vice Mayor Barrett, seconded by Councilmember Hunt, to: * Adopt RES. 06-67 authorizing the acceptance of a Selective Traffic Enforcement Program (STEP) grant from the Governor’s Office of Highway Safety in the amount of $50,297.04 to fund eight moving radar units and overtime to focus on aggressive driving, speed, DUI, seatbelt, and child restraint violations (LCON03206); and * Approve a budget amendment in the amount of $20,046 from the Proposed Grants Contingency Account to the Occupant Protection Enforcement Program Grant Fund – Overtime Account and $30,251.04 from the Proposed Grants Contingency Account to the Occupant Protection Enforcement Program Grant Fund – Operational Supplies/Equipment Account. Upon vote, the motion carried unanimously. 16R Contract, Sundt Construction, Pre-Construction Services, Butler Drive Water Reclamation Facility and Influent Pump Station Shawn Kreuzwiesner, Utilities Engineering Manager, explained that two projects before Council relate to the Butler Drive Water Reclamation Plant: the Reclamation Facility and the Influent Pump Station. The offsite pipelines will be contracted separately at a later date. Mr. Kreuzwiesner presented an overview of the location of the Butler Drive Water Reclamation Plant, Influent Pump Station and planned pipelines. Mr. Kreuzwiesner reported on the proposed Construction Manager at Risk contract with Sundt Construction for design phase services associated with the Reclamation Facility and Influent Pump Station. A total of seven construction firms submitted proposals and were reviewed. The three highest scoring firms were interviewed and Sundt Construction was selected. Mr. Kreuzwiesner stated that this pre-construction phase contract is for a Guaranteed Maximum Price for the Butler Drive Water Reclamation Facility. Until the design is complete, Sundt will also provide constructability reviews and detailed cost estimates prior to providing their final Guaranteed Maximum Price for this portion of the project scope. In response to questions from Councilmember Dennis, Mr. Kreuzwiesner stated that the plant will allow for future expansion. He advised that Utilities Department will work with the Parks Department to allow for irrigating future parks. Motion was made by Councilmember Leone, seconded by Vice Mayor Barrett, to: * Award a contract in an amount not to exceed $423,168 to Sundt Construction for construction manager at risk design phase services associated with the Butler Drive Water Reclamation Facility and Influent Pump Station (LCON03306); * Authorize the use of reserves from the Wastewater Expansion Fund; and * Authorize a budget transfer in the amount of $242,653 from the Wastewater Expansion Fund Contingency Account to the Wastewater Expansion Fund, Wastewater System Account. Upon vote, the motion carried unanimously. 17R Contract, Peoria Water Users Association, Peoria Irrigation System Steve Kemp, City Attorney, reviewed the Asset Purchase Agreement and Irrigation Facility Services Agreement between the Peoria Water Users Association and the City of Peoria for the transfer of the downtown Peoria irrigation system. Mr. Kemp reported that Staff recommended approval. In response to questions from Council, Mr. Kemp clarified that the City was conveying the irrigation system “as is.” Brent Mattingly, Finance Director, advised that the irrigation system can be operated, but that a pipe can break at anytime. In response to questions from Councilmember Carlat, Mr. Kemp stated that the Peoria Water Users Association would be expected to operate like any other business including: paying appropriate fees and taxes. The City charges all utilities a five percent franchise fee. Mr. Mattingly noted that the Peoria Water Users Association would be responsible for all damages if a pipe broke. He added that a break would more likely occur in an alleyway than a major street as the City has replaced many pipes during recent construction projects. Mr. Mattingly emphasized that the Peoria Water Users Association would be responsible for any damages. Councilmember Hunt expressed concern with the number of calls she receives regarding the irrigation system. Mr. Kemp responded that if there were a problem reported to the City, the City would work with the Peoria Water Users Association to notify citizens who was the responsible party to contact. He noted that the City of Peoria charges 1.15 times the project costs to make repairs. Councilmember Hunt stated that because of her concerns that the users may not fully understand what they have undertaken, she would vote against the contract. Terry Ellis, City Manager, directed Staff to write a letter to all those affected by the Peoria Water Users Association to explain how the agreement was structured. Motion was made by Vice Mayor Barrett, seconded by Councilmember Dennis, to: * Approve the Asset Purchase Agreement and Irrigation Facility Services Operating Agreement between the Peoria Water Users Association and the City of Peoria for the transfer of the downtown Peoria irrigation system (LCON03406 and LCON03506); * Approve the Assignment of Irrigation Easements to the Peoria Water Users Association; and * Authorize the City Manager and/or City Attorney to execute all documents necessary to complete the transaction. Upon vote, the motion passed by a vote of six to one with Councilmember Hunt voting “no.” CALL TO THE PUBLIC: (NON-AGENDA ITEMS) Mr. Smokey Stovec, Peoria resident, spoke regarding an upcoming Benefit Ball to be held on April 29, 2006 at the Masonic Hall to benefit Officer Bill Weigt and his family. Reports from the City Manager: Neighborhood Traffic Management Program Terry Ellis, City Manager, introduced Jamal Rahimi, City Traffic Engineer, and asked him to present an overview of the Neighborhood Traffic Management Program (NTMP). Mr. Rahimi introduced Margaret Boon-Pixley, Transportation Planning Engineer. Mr. Rahimi advised Council that the Neighborhood Traffic Management Program (NTMP) was in its fifth year. He reviewed the program and emphasized that although there was a slight decrease in the number of projects, more money was actually spent. Mr. Rahimi summarized Staff’s recommendations for policy changes to the program including incorporating a policy for removing measures installed by the program, revising the Traffic Study Policy for determining boundaries, and streamlining the petition process. Mr. Rahimi advised that the proposed policy changes for boundaries would give Staff the flexibility to establish boundaries as each project is unique. He added that proposed changes would also simplify processes including the funding schedule. Mr. Rahimi stated that the NTMP program goal for 2007 is to complete projects within one year of the request. In response to questions from Councilmember Dennis, Mr. Rahimi advised that the current requests to remove speed bumps would not be affected by the proposed changes. This was a report only on the proposed changes which will come before the Council for formal adoption in approximately one month. In response to questions from Council, Ms. Boon-Pixley stated that it costs twice as much to remove a chicane than to install one, approximately $20,000, and it costs approximately $4000 to remove a speed bump. Mr. Rahimi also explained that new development guidelines would also be updated. Terry Ellis, City Manager, reported that there was funding in the proposed budget to catch up on outstanding projects. Discussion ensued regarding the number of speed bumps installed each year. Councilmember Dennis thanked Staff for a successful program. Budget Review: Mr. Ellis announced that Council would begin the Budget Review on Friday, April 7, 2006, at 1 p.m. in the Public Safety Administration Building. The public was invited to attend. Reports from City Council: Councilmember Dennis announced that the recent Peoria Pioneer Days event was very successful. She also invited the public to attend the “Movies in the Park” program at the Kiwanis Park; Councilmember Dennis explained that the screen was clear and the sound was great. Vice Mayor Barrett reported on the potential impact of Legislative House Bill 2740. The current law requires a restaurant with a liquor license to serve a minimum of 40 percent food sales; the current bill would lower the requirement to only serving 20 percent food sales. Councilmember Carlat thanked the individuals who serve on the many City boards and commissions providing their valuable expertise. Councilmember Leone highlighted a number of recent events he had attended including: a special event at the Sports Complex to support Luke Air Force Base, Miss Arizona Teen Pageant, Luke ROTC Awards event, and Pioneer Days. Councilmember Leone stated that he was proud that two finalists in the Miss Arizona Teen Pageant were from Peoria. Councilmember Hunt reported that the Downtown Festival was the best this year blending new residents and long term residents. Councilmember Hunt asked the public to bear with the City during the construction projects in the downtown area. The finished product would be great. Reports from the Mayor: None.
