Recreational and Motor Vehicle Use in Desert Areas

An ATV Quad in the Arizona desertThe Peoria Police Department welcome motorized recreation enthusiasts on public lands. We have developed this brochure in an effort to better manage motorized recreation and provide rider education so that you can continue to enjoy your riding areas.

BACKGROUND

Since 2002 numerous citizen complaints and calls for service have resulted from the high volume of recreational and motor vehicles that are being driven in the desert.

The City of Peoria has experienced a substantial increase in calls for police service relating to the use of recreational vehicles. The complaints received from citizens are:

  • Excessive noise from recreational and motor vehicles being used in the desert

  • Health problems caused by excessive dust

  • Trespassing on state and private land and desert areas

  • Dumping of garbage on desert land (trash, landscape and construction debris, discarded appliances, etc.)

  • Desert parties involving underage consumption of alcohol and drugs

  • Injuries/accidents with OHVs

ARIZONA STATE STATUTES AND PEORIA CITY CODE

Peoria City Code Sec. 13-25
Use of vehicles on vacant property.

(a) It is unlawful to operate, drive or park any motor vehicle, motorcycle, motor scooter, mini-bike, trail bike, dune buggy, jeep or other form of transportation, propelled by an internal combustion engine, upon the vacant unimproved private property of another without the written license issued by the owner of the property or the person entitled to the immediate possession thereof or the authorized agent of either.
(b) A person who operates a vehicle in the manner for which a license is required shall immediately display such license to any peace officer upon request of such peace officer.

Arizona Revised Statute
13-1603. Criminal littering or polluting: classification

A. A person commits criminal littering or polluting if such person without lawful authority des any of the following:
1. Throws, places, drops or permits to be dropped on public property or property of another which is not a lawful dump any litter, destructive or injurious material which he does not immediately remove.
2. Discharges or permits to be discharged any sewage, oil products or other harmful substances into any waters or onto any shorelines within the state.

Arizona Revise Statute
13-1502. Criminal trespass in the third degree; classification

A. A person commits criminal trespass in the third degree by:
1. Knowingly entering or remaining unlawfully on any real property after a reasonable request to leave by the owner or any other person having lawful control over such property, or reasonable notice prohibiting entry.
2. Knowingly entering or remaining unlawfully on the right-of-way for tracks, or the storage or switching yards or rolling stock of a railroad company.
B. Criminal trespass in the third degree is a class 3 misdemeanor.

Arizona Revise Statute
37-501. Trespass on state lands; classification

A person is guilty of a class 2 misdemeanor who:
1. Knowingly commits a trespass upon state lands, either by cutting down or destroying timber or wood standing or growing thereon, by carrying away timber or wood there from, by mowing, cutting, or removing hay or grass thereon or there from, or by grazing livestock thereon, unless he has a lease or sublease approved by the department for the area being grazed.
2. Knowingly extracts or removes oil, gas, coal, mineral, earth, rock, fertilizer or fossils of any kind or description there from.
3. Knowingly without right injures or removes any building, fence or improvements on state lands, or unlawfully occupies, plows or cultivates any of the lands.
4. With criminal negligence exposes growing trees, shrubs or undergrowth standing on state lands to danger or destruction by fire.
